Visa 186 Business Plan

The Employer Nomination Scheme Visa (subclass 186) lets skilled workers who their respective employers nominate live and work in Australia permanently. However, you must meet the necessary skills for the job to be eligible, and the employer must have a genuine need for an ongoing permanent position.

There are three streams under the visa subclass 186:

1.     Direct Entry Stream

This visa lets skilled workers who have an occupation on the list of eligible professional careers with sufficient experience (at least 3 years) to be nominated by an Australian employer. Before they apply, they need to have a positive skills assessment unless they are exempted.

2.     Labour Agreement Stream

The labour agreement stream lets skilled workers nominated by their employers live and work in Australia indefinitely. This is for the employees who are currently working or will work for an employer under a labour agreement. The employee must have competency in English, skills, and experience for the position.

3.     Temporary Residence Transition Stream

This stream lets the skilled employers who currently hold 457, TSS, or related bridging visas like A, B or C get nominated by their employers to live and work in Australia permanently. However, you must have experience working with your current employer for at least three years.

Why do you need a business plan for this visa?

As an employer and a sponsor for your employee, you must gather and submit various documents to apply for the nomination. You must prove to the Australian Government that you have an active and lawful business operating in Australia.

Your migration business plan for the application needs to describe the following things adequately:

• Company Overview
• Detailed Organisational Structure Chart with the name of the occupation and its ANZSCO code (for Direct stream)
• Position Description including specified tasks and duties where applicable (for Direct stream)
• Product or Service descriptions
• Financial Statements such as Audited Balance Sheets, Profit and Loss Statements of the recent most concluded fiscal year with the previous year’s comparative figures.
• Business Tax Returns and associated tax assessment notices for the most recently concluded fiscal year.
